We make every reasonable effort to display as accurately as possible the colors, patterns, dimensions, finishes, and details of our products in our online store. However, we cannot guarantee that your device’s display of any color, texture or image will be entirely accurate.

Many of our products are handmade or hand-finished. As a result, slight variations in color, size, motif placement, glaze, texture, finish, shape, or detail may occur. Such variations are part of the handmade nature of the products and are not considered defects.

All product descriptions, images, specifications, dimensions, materials, availability, and pricing are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and to limit the quantity of any product or service that we offer.

We do not warrant that the quality, appearance or characteristics of any product purchased by you will precisely match how it appeared on your screen or how you subjectively expected it to appear.

SECTION 3 - ORDERS

When you place an order through our Services, you are making an offer to purchase. Maroxa Home reserves the right to accept or reject any order for any reason at its sole discretion.

Your order is not accepted until we send you an order confirmation or otherwise expressly confirm acceptance. We must receive authorization and confirmation of payment before your order is accepted and processed.

Please review your order carefully before submitting it. Once an order has been accepted, we may be unable to modify or cancel it, particularly where processing, packaging, fulfillment or made-to-order production has already started.

We reserve the right to refuse, limit, cancel or modify an order in cases including, but not limited to:

  • pricing or product description errors,
  • stock inaccuracies,
  • unusual or excessive quantity requests,
  • resale-related concerns,
  • delivery restrictions,
  • or any other legitimate commercial or legal reason.

If we cancel or modify an order after payment has been processed, we will attempt to notify you using the e-mail address, billing address, or phone number provided at checkout, and where appropriate, issue a refund.

Your purchases are subject to our Refund Policy, Shipping Policy, and any product-specific conditions stated on the website.

You represent and warrant that purchases made through our Services are intended for personal, household, gifting, or legitimate business use, and not for unlawful resale, redistribution, or export in violation of applicable law.

All prices displayed on our website are listed in the applicable currency shown at checkout and are subject to change without notice.

Unless expressly stated otherwise, posted prices do not include shipping charges, handling charges, customs duties, import taxes, local taxes, VAT, or other governmental charges that may apply depending on your jurisdiction. Such charges, where applicable, will be shown during checkout or remain your responsibility upon delivery.

The price charged for a product or service will be the price in effect at the time the order is placed, and this will be reflected in your order confirmation.

In the event of a conflict between promotional terms and these Terms, the promotional terms shall govern to the extent of that conflict.

You agree to provide current, complete and accurate purchase, billing, shipping, payment and account information for all purchases made at our store. You agree to promptly update such information so that we can complete transactions and contact you if needed.

You represent and warrant that:

  1. the payment information you provide is true, complete and accurate,
  2. you are authorized to use the chosen payment method,
  3. charges incurred by you will be honored by your payment provider,
  4. and you will pay all charges incurred at the prices in effect at the time of purchase, including applicable shipping and taxes.

SECTION 5 - SHIPPING AND DELIVERY

We aim to process and ship orders within the estimated timeframes stated on our website. However, all processing and delivery times are estimates only and are not guaranteed.

Certain items may be sold as pre-order, made-to-order, or produced in small batches. In such cases, delivery may take longer than standard in-stock items. By purchasing such items, you acknowledge and accept that estimated shipping dates may vary.

We are not liable for shipping or delivery delays caused by factors outside our reasonable control, including but not limited to:

  • courier delays,
  • customs processing,
  • transportation disruptions,
  • weather events,
  • supplier delays,
  • force majeure events,
  • public holidays,
  • strikes,
  • regulatory delays,
  • or incorrect customer information.

Risk of loss and title for products pass to you upon delivery of the products to the carrier or upon delivery to the shipping address provided, to the extent permitted by applicable law.

It is your responsibility to ensure that shipping details are complete and accurate. We are not responsible for failed delivery or additional shipping charges arising from incorrect or incomplete address information submitted by you.

SECTION 6 - PRE-ORDERS

Some products offered through Maroxa Home may be sold on a pre-order basis. By placing a pre-order, you understand and agree that:

  • the item may not be immediately available for shipment,
  • the estimated dispatch or delivery window is approximate only,
  • production, sourcing, or supply chain delays may occur,
  • and final fulfillment timing may differ from the initial estimate.

Unless otherwise required by applicable law or expressly stated in our Refund Policy, pre-order purchases may be treated differently from standard in-stock items, particularly once production, sourcing, or order allocation has begun.

Where the website states that an item is handmade, made to order, or available by pre-order only, you acknowledge that such conditions are part of the product offering and form part of the purchase agreement.

SECTION 7 - INTELLECTUAL PROPERTY

The Services and all content included on or made available through the Services, including but not limited to text, graphics, photographs, product imagery, logos, button icons, videos, audio clips, downloads, digital content, product descriptions, page layouts, branding elements, and software, are owned by Maroxa Home, Shopify, our affiliates, licensors, or content suppliers, and are protected by copyright, trademark, design, and other intellectual property laws.

The names “Maroxa Home”, our logos, product names, collection names, designs, and slogans are trademarks or trade dress of Maroxa Home or its licensors. Shopify’s marks remain the property of Shopify. All other trademarks are the property of their respective owners.

We may provide you with access to tools, services or applications offered by third parties which we neither monitor nor control, and over which we have no input.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

Maroxa Home is powered by Shopify, which enables us to provide the Services to you. However, any sale or purchase made through our store is made directly between you and Maroxa Home.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Maroxa Home, including but not limited to product quality, product delivery, refunds, pricing, warranties, or claims arising out of your purchase or use of products sold by Maroxa Home.

You hereby release Shopify and its affiliates from any claims, damages, losses, liabilities, costs or expenses arising from or related to your purchases, transactions, disputes or interactions with Maroxa Home.

SECTION 11 - PRIVACY POLICY

All personal information collected through the Services is subject to our Privacy Policy, which forms part of these Terms of Service.

Because the Services are hosted by Shopify, Shopify may also collect and process certain personal information about your access to and use of the Services in order to provide and improve the Services. Because many of our products are handmade, artisan-made, hand-painted or pre-ordered, you acknowledge that slight differences, delays, and non-material variations may occur.

To the fullest extent permitted by applicable law, in no event shall Maroxa Home, its affiliates, directors, officers, employees, agents, contractors, service providers, licensors, or Shopify and its affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including without limitation lost profits, lost savings, loss of business, loss of goodwill, loss of data, replacement costs, or any similar damages, whether based in contract, tort, negligence, strict liability or otherwise, arising from your use of the Services or any products purchased through the Services.

This includes, without limitation, any claims related to:

  • errors or omissions in any content,
  • product variations inherent to handmade goods,
  • shipping delays,
  • pre-order delays,
  • third-party service interruptions,
  • or any loss or damage incurred as a result of the use of the Services or products.

Nothing in these Terms shall exclude or limit liability where such exclusion or limitation is prohibited by applicable law.
